Welcome to Klozey.

These Terms of Service (“Terms”) govern your access to and use of klozey.com (the “Site”) and your purchase of products from Klozey.

The Site is operated by Klozey Limited, a company registered in England and Wales under company number 14977170, with its registered office at 58 Peregrine Road, Office 3854, Ilford, Essex, England, IG6 3SZ (“Klozey”, “we”, “us”, or “our”). 

By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree to these Terms, you should not use the Site or purchase products from us.

1. Our Store

Klozey operates an online fashion retail store serving customers in the United States.

Products displayed on the Site are offered for retail purchase subject to availability, these Terms, and any additional conditions displayed on the applicable product page.

Our current customer shipping destination is the United States only.

2. Eligibility

By placing an order with Klozey, you confirm that you are legally capable of entering into a binding contract.

If you are under the age of majority applicable where you live, you may use the Site only with the involvement and permission of a parent or legal guardian.

You may not use our products, Site, or services for unlawful or unauthorized purposes.

3. Products

We make reasonable efforts to display our products, descriptions, photographs, colors, measurements, sizing information, availability, and other product information accurately.

However, the appearance of colors and other visual characteristics may vary depending on your device, screen, display settings, and lighting.

Measurements and sizing information may also contain reasonable variations associated with garment manufacturing and measurement methods.

We reserve the right to modify or discontinue products, product variants, collections, or other offerings without prior notice.

All products are subject to availability.

4. Prices

Unless otherwise stated, prices displayed on Klozey are shown in U.S. dollars (USD).

We may change product prices at any time before an order is placed.

A price change will not affect an order that has already been accepted by us, except where an obvious pricing or technical error has occurred.

Applicable taxes, if any, will be calculated or displayed during checkout in accordance with applicable requirements.

5. Orders

Submitting an order does not necessarily mean that we have accepted it.

After placing an order, you may receive an automated order confirmation acknowledging that we received your order.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases involving:

• Product unavailability
• Incorrect pricing or product information
• Suspected fraud or unauthorized payment activity
• Payment authorization failure
• Technical or inventory errors
• Violation of these Terms
• Orders that we reasonably believe are intended for unauthorized resale or other improper purposes

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

6. Payment

Payment must be made using a payment method offered during checkout.

By providing payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charge for your order.

Payments may be processed by third-party payment service providers. Your use of a particular payment method may therefore also be subject to the payment provider’s terms and privacy practices.

We do not guarantee that every payment method will be available for every transaction.

7. Shipping

Klozey currently ships to customers within the United States.

Standard shipping is free on Klozey orders.

Products sold through Klozey ship from within the United States.

Our standard estimated delivery time is generally 2–5 business days.

Delivery times are estimates and are not guaranteed. Circumstances outside our reasonable control, including carrier delays, severe weather, holidays, address problems, and transportation disruptions, may affect delivery.

An order containing multiple products may be delivered in separate packages.

Full shipping conditions are provided in our Shipping Policy, which forms part of these Terms.

8. Shipping Addresses

You are responsible for providing accurate and complete delivery information.

Please contact support@klozey.com as soon as possible if you discover an error in your shipping information.

We cannot guarantee that an address can be changed once an order has entered fulfillment or been shipped.

Except where required by applicable law or where the error was caused by us, Klozey is not responsible for loss resulting from incorrect shipping information supplied by the customer.

9. Returns and Refunds

Eligible products may be returned in accordance with our Return & Refund Policy.

Return requests generally must be initiated within 7 days of delivery, and approved returns must satisfy the eligibility and condition requirements stated in that policy.

Certain products are final sale or non-returnable for hygiene, safety, or other reasons. These include categories identified in our Return & Refund Policy.

We do not currently offer direct exchanges.

Our Return & Refund Policy forms part of these Terms and should be reviewed before placing an order.

Nothing in these Terms or our Return & Refund Policy excludes rights that cannot lawfully be excluded.

10. Promotions and Discount Codes

From time to time, Klozey may offer promotions, discount codes, special pricing, or other offers.

Promotions may:

• Be available for a limited period
• Apply only to selected products or customers
• Require a minimum purchase
• Exclude certain products
• Be limited to one use per customer
• Be incompatible with other promotions

Unless expressly stated otherwise, promotional codes cannot be exchanged for cash.

We reserve the right to cancel or refuse a promotion where we reasonably determine that it has been obtained or used fraudulently, unlawfully, or contrary to its stated conditions.

11. Accounts

Certain Site features may allow you to create or use a customer account.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account to the extent permitted by applicable law.

Information you provide must be accurate and current.

If you believe your account has been accessed without authorization, contact support@klozey.com.

We may suspend or restrict an account where reasonably necessary to protect customers, Klozey, or the security of the Site.

12. Reviews and User Content

If you submit a product review, photograph, comment, feedback, or other content to Klozey, you confirm that you have the right to submit that material.

You must not submit content that is unlawful, fraudulent, defamatory, threatening, infringing, deceptive, obscene, or otherwise violates the rights of another person.

Subject to applicable law and any specific terms presented when content is submitted, you grant Klozey a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute content you voluntarily submit in connection with our business, products, Site, and marketing.

We reserve the right to moderate or remove content where reasonably necessary.

13. Intellectual Property

The Site and its contents, including Klozey branding, graphics, design elements, text, software, layout, and other materials owned by Klozey are protected by applicable intellectual property laws.

Third-party trademarks, brand names, product images, and other materials remain the property of their respective owners.

You may use the Site for personal, non-commercial shopping purposes.

You may not reproduce, distribute, commercially exploit, scrape, republish, or misuse protected Site content without authorization from the applicable rights holder.

14. Prohibited Uses

You must not use the Site to:

• Violate applicable law
• Commit or facilitate fraud
• Submit false or misleading information
• Infringe intellectual property or other rights
• Transmit malware or malicious code
• Attempt unauthorized access to the Site or related systems
• Interfere with the security or operation of the Site
• Scrape, crawl, or automatically extract Site content in an unauthorized manner
• Circumvent purchasing, security, fraud-prevention, or access controls
• Impersonate another person or misrepresent your identity

We may restrict access to the Site where reasonably necessary in response to prohibited activity.

15. Third-Party Services

The Site may rely on or contain links to third-party services, including payment processors, shipping carriers, analytics services, social networks, and ecommerce technology providers.

Those third parties operate independently and may have their own terms and privacy policies.

A link to or integration with a third-party service does not necessarily constitute an endorsement of everything offered or stated by that third party.

16. Website Availability

We aim to keep the Site available and functioning correctly, but we do not guarantee uninterrupted or error-free operation.

We may temporarily restrict or suspend access for maintenance, security, upgrades, technical problems, or circumstances outside our reasonable control.

We may modify features or functionality of the Site from time to time.

17. Disclaimer

We endeavor to provide accurate information and reliable ecommerce services.

To the maximum extent permitted by applicable law, the Site is provided on an “as available” basis, and we do not guarantee that the Site will always be uninterrupted, error-free, or free from every harmful component.

Nothing in these Terms excludes warranties, guarantees, or other rights that cannot legally be excluded.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection law.

To the maximum extent permitted by law, Klozey Limited will not be liable for indirect, incidental, special, or consequential losses arising from your use of the Site or purchase of products where such losses were not reasonably foreseeable.

Nothing in these Terms is intended to limit your statutory consumer rights.

19. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims reasonably incurred by Klozey Limited resulting from your unlawful use of the Site, your material violation of these Terms, or your infringement of another person’s rights.

This provision does not impose liability on a consumer where doing so would be prohibited by applicable law.

20. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using Klozey, you acknowledge that your information may be processed as described in that policy and as permitted or required by applicable law.

21. Electronic Communications

When you place an order, create an account, or contact us electronically, we may communicate with you electronically regarding your transactions, account, customer-service requests, or other service-related matters.

Marketing communications are subject to applicable consent requirements, and where applicable you may unsubscribe using the method provided in the communication.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices, or applicable requirements.

The current version will be published on the Site with an updated “Last updated” date.

Changes will apply prospectively except where otherwise required by law.

23. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be applied to the maximum extent legally permissible or severed where necessary.

The remaining provisions will continue in effect.

24. No Waiver

If Klozey does not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce that provision later.

25. Entire Agreement

These Terms, together with the policies expressly incorporated into them, constitute the agreement between you and Klozey concerning your use of the Site and purchases made through it, subject to any rights that cannot legally be excluded.

26. Governing Law

These Terms and the relationship between you and Klozey Limited are governed by the laws of England and Wales, except to the extent that mandatory consumer protection laws applicable to you provide otherwise.

Nothing in this section deprives a consumer of protections or remedies that cannot lawfully be waived by contract.
